Introduction Strategic management is among the most powerful tools of management in a company. This is where the general managers of the company take the initiative of planning the future needs and goals of the company. In this case, the general managers try to evaluate the strength, weakness, opportunities and threat analysis (SWOT) of the company so that they can be able to plan the future goals. It may appear to be difficult, but if a company takes this opportunity, they might gain an advantage over their competitors. Therefore, this paper is about the strength, weaknesses, opportunities and threats analysis (SWOT) of Star Bulk Company. Discussion Star Bulk is a global shipping company that deals with shipping of dry goods via the sea. It was incorporated in the Marshall Islands on December 13, 2006 (Star Bulk, 2012). Since then, the company has gained global significance in the transport sector. The company ships goods via the sea from one destination to the other. It mainly focuses on Capesize, large Handymax and secondarily on Panamax vessels (Star Bulk, 2012). For the company to prosper they have to plan their SWOT analysis effectively thus gaining competitive advantages. The strengths of Star Bulk Company include good customer relation. All over the world in the leading companies, Star Bulk has created good customer relationships. This is ensuring the retaining of many customers in the company. Henceforth, they have a wide base of loyal customers. Secondly, they use modern quality fleets. This reduces their expenses and it provides safety to their customers thus gaining the competitive advantage over their competitors. Thirdly, they have a strong management team with vast experience (Star Bulk, 2012). Henceforth, they are able to make excellent strategies. Lastly, they are efficient in shipping management ensuring the professionalism to their customers. The weaknesses of the Star bulk include the effects of the financial crises that are happening globally. Many of their customers are closing down their business operations until the financial crises are over. Therefore, Star Bulk business operations have gradually reduced making the company operate on losses. Additionally, the company is being affected by the shipping laws of different company. Although it may not affect them much, it is creating to problems to the company (Star Bulk, 2012). Therefore, the company needs to change this situation. The opportunities that Star Bulk Company wants to invest in are based on taking advantage of the marketing during the peak season. Additionally, the company is trying to train their employees on safety regulations of handling the goods while they are in transit. This will attract more customers. This is because customers trust a company that ensures safety in the transportation of their goods and services (Market Watch, 2011). Henceforth, when the company invests in these opportunities it will make profits. Lastly, these are threats of the star Bulk Company. These companies are providing the same services as Star Bulk thus sharing the market. It has so many competitors one of them being FedEx Corporation (Star Bulk, 2012). These companies are taking some of their customers in areas where they are unable to transport. For instance, they do not transport parcel or liquids via the sea. As a result, they have lost customers to their competitors. If this continues, they can close down completely due to lack of business. Conclusion Based on the above, SWOT analysis of Star Bulk Company, general managers of different should first prepare their analysis. According to Star Bulk, they have good customer relations creating a wide base of loyal customers. On the other hand, they are threatened by competitors. Therefore, they will have to ensure that they take the opportunity during the peak season to show professionalism. A         In Randall Kennan’s work, ‘the foundations of the earth’ he expressly implies that for an African American to live in the southern America it is nearly impossible to live if not impossible in the south with a sexual orientation for similar sex. They face backlash from the religious society who are opposed to accepting homosexuality as a sexual orientation. Emily Dickinson in her literature work ‘Much madness is divinest sense’ Dickinson implies that those who are thought to be mad in a society are truly sane, but it is how society discriminates against such people. She claims that the society is instead mad and not the individual themselves. Toni Cade Bambara in her literature work was mainly talking about how people resolve their conflicts, but its implied claim was at there lacks economic equity in the in the United States of America especially among the poor people and American minorities.

B         Randall Kennan demonstrates this social prejudice against gay people by the presence of a fictional character by the name of Maggie McGowan Williams who is a very old black woman. She tries to come into terms with the fact that her grandson Edward is a homosexual. Edward is in a relationship with his lover Gabriel, who is a minister at the TimCreek’s Baptist church. This clearly shows how the writer tries to intertwine and relate the religious prejudice yet the church workers have different sexual orientation compared to what they preach. Emily Dickinson clearly demonstrates this claim by attempting to contrast the situations by the use of the terms ‘mad’ and ‘much madness’. She expressly states, “Much madness is divinest sense” to mean that the person thought to be mad is a matter of fact the most sensible person in the society. She tries to put across the fact that, for a discriminative individual who is willing to delve into the search of intricate meanings it can mean the presence of superiority of the individual’s character. The presence of madness in an individual enables the individual to sight what others cannot be able to see, thus making this ability a very desirable character for many in the society. Toni Cade Bambara, in her literature work ‘the lesson’, goes to question the unequal wealth distribution among the different people and races in the American society. She uses a young girl, Sylvia, who lives in a poor neighborhood. This is clearly shown by the presence of her cousin, her family moved up north, and they all had to share a very small apartment. This is evidenced by the presence of a foul stench in the hallway due to the presence of clutter and urine, Such that they could not play in the hallway.

C         In Kenan’s work, he tries to show how Maggie tries to cope with her grandson’s sexuality and soon after his death in a car crash, she tries to find answers as to what led to his preferred sexual orientation. She clearly shows a remarkably distinct character by being forgiving and warm towards Gabriel, whom she blamed for influencing Edward’s sexuality and decision to move away. She attributes the decision to move away from home as the main cause of death. Edward as one of the key figures goes on to show how the sexual prejudice has affected the black community. He says that it is easier being gay than being black. He states that black people can always pass as being straight with regard to their sexuality, but they cannot always pass as being white. This brings forth a very powerful rhetoric as to how racial prejudice and sexual prejudice are viewed in the American society, Maggie is exceedingly sorrowful towards her grandson’s fate and at times, she blames herself for not preventing him from going away with Gabriel. This arouses pity for her as she is left alone. Emily Dickinson in her works depicts the presence of a distinct character by the presence of ‘madness’ in an individual as being a trait that enables the individual to see or identify what the common eye cannot discern, referring to the common people. This elicits pity for such an individual who is discriminated against due to his ability to discern issues and is viewed as a common outcast because of his stance issues, unlike the common people. Toni Cade Bambra in her works ‘the lesson” draws the picture of a girl, Sylvia, very sharp in noticing the inequalities around her. She is able to live in very tough economic conditions; however, she is able to withstand it all. For a very witty girl, she has to endure many hardships living with her large family in a very small house. During her outing with Miss Moore, she has to witness stores selling expensive toys yet many families could use an equal amount of money to buy food, this shows the inequalities in the society and draws a lot of empathy for those unable to afford such privileges.

D         In society, the presence of inequalities is abundantly evident. In Toni Cade Bambara’s literature, she asks a question through Miss Moore, as to whether people can buy toys at same prices that other large families use to feed themselves. It puts into sharp focus the need for social and economic balances in the division of wealth regardless of race or ethnicity. Ken poses many questions to the society. The presence of social prejudice against certain races and how religions are very prejudicial against sexual orientation yet it exists in the religions. This puts into light how people need to re-evaluate their perceptions against certain issues in society. In Emily Dickinson, the focus was mainly on the presence of prejudice against people who have different views about certain issues in society. This goes to reiterate that there is a need for people to change their own attitudes that have been at the backbone of discrimination due to sexual orientation, financial positions, races and views on issues in society.

I. Introduction

Technology is drastically changing globally, and the organizations that are quick to adopt new technology are attaining a competitive advantage over other companies. Organizations are updating to new versions of technology, and the internet has increased in complexity. Additionally, the security protocols on the internet have changed entirely (Hart, & Project Gutenberg. 2005). For this reason, the rules of internet usage and the security protocols need to be implemented for the purposes of protecting the organization and gaining competitive advantage over other companies. Therefore, the company should take the initiative and be the pioneer in technological advances.

II. Discussion

i) Reasons  of implementing rules on internet usage

With the changing technological environment, the organization should change its rules on internet usage (Hart, & Project Gutenberg. 2005). The first reason is to protect employees from being exposed to inappropriate information that can lead to legal ramifications. For instance, an employee might unintentionally find inappropriate materials like pornography in the internet that could lead to serious trouble for the organization (Anandarajan & Simmers, 2002). Therefore, to reduce such incidents the company needs to change the internet usage rules.

In the past few years, so many social sites on the internet are being created. All the generations, the young and the old have come to enjoy them. This is positive because they are making communications between the different people easier and faster as compared to other forms of communication. However, the problem is that when they are being used during working hours, they lower the productivity of the employees. It has been noted that in the company, the productivity of the employees is on the decrease (Anandarajan & Simmers, 2002). This has been attributed to time loss when they are chatting on the internet with friends using the social sites. Henceforth, the rules on internet usage need to be change to increase the employee productivity.

Lastly, many computer threats emanating from the internet are on the rise. With the current rules on internet usage, employs are able to access the internet without fear of these threats. Additionally, not every employee in the organization is literate in relation to the computer threats. Therefore, they might unintentionally allow malware and viruses into the system. Additionally, hackers can gain access stealing or destroying the organization’s information. Therefore, there is a need to change the existing rules on the internet usage.

ii)     Advantages of implementing the rules on internet usage

One of the main advantages of implementing the rules on internet usage is an increase in employee productivity. When employees are not concentrating on the social sites, they will be more actively involved to their work thus increasing the employee’s productivity (GFI. 2011). For example, an employee who used to browse these sites stops, the time he or she uses will be diverted to work activities resulting to an increase in productivity. This will lead to an increase in the profits at the end of the financial year of the organization profits. However, there should be a compromise on the part of the employees where they should be given the opportunity to browse the social sites during free time (GFI. 2011). In this case, it will motivate employees to work that extra mile since the company is considering their own personal needs.

Secondly, the amount that is used to settle legal ramification due to internet usage of inappropriate sites will reduce drastically. In many cases, when employees are involved in such a situation the organization names suffer when it is exposed to the public. For instance, when an employee engages in pornography, the public might think that the whole company is like that, and as a result, customers refrain themselves from being associated with the company. This causes the company to lose customers. In addition, the company also ends paying money to settle fines due to legal ramification. However, if the rules are implemented, this will be advantageous to the organization because the profits will increase and the company’s name will be saved.

iii) Reasons for creating or implementing the internet security

Currently, the organization is using obsolete security systems that protect the organizations from unauthorized access. Globally, technology has changed entirely. Similarly, the internet security protocols have changed entirely (Hart, & Project Gutenberg. 2005). In this case, unauthorized access by hackers or competitors is on the rise putting the company information at risk (Avolio, 2012). However, if the existing internet security is implemented or a new one is created there will be no information loss to the competitors or the hackers. For this fact, the organization needs to implement the internet security protocols.

Finally, with the current internet connection the organization is using, other outside users who are nearby they can gain access and use it. In this case, the network bills are on the rise and create a reduction of the organization profits in the end of the financial year (Avolio, 2012). Additionally, a person can be able to hack the system when he or she is just outside the building. This can lead to distortion of the organizations information (Avolio, 2012). Henceforth, the organization needs to consider changing the information.

iv)    Advantage of creating or implementing internet security protocol

First, the company will save a lot of money that was being used by outsiders who were able to access the system. There are malicious people who enjoy using free stuff. In this case, when they get an opportunity of using the free internet, they will utilize it maximally (Avolio, 2012). Henceforth, the organization ends up paying an enormous bill for something that could have been reduced in the first place. Therefore, when the company implements the internet security protocols the company will start realizing massive profits from they money they could have paid if the outsiders have access to the network.

The organization secrets and information will be saved from unauthorized people from accessing it. Organization secrets are the key to excellent performance or the competitive advantage over the other companies. If the outsiders gain access to such information, they might end up using the information to the organization’s disadvantage. For instance, the companies might gain access to such information (Avolio, 2012). In this case, they will know why the organization has been succeeding. Henceforth, they will use the information to their own advantage. Additionally, the company will not lose any information to hackers. Moreover, the organization’s information will not be distorted in any way (Avolio, 2012).

Conclusion

In the past, technology was underdeveloped, and not many organizations used technology. However, as the years have passed by, technology has become complex with new things being created every day. The internet has grown gradually with many applications being created. For this reason, the company needs to conform to the latest technology by implementing the exiting rules on internet usage and internet security. Therefore, based on the analysis, it is dangerous for the company not to consider implementing the existing rules or creating new rules of internet usage and internet security.

Introduction

Why are certain communities vulnerable to certain diseases? In many cases, there are diseases that affect a certain community. This can be because of the characteristics of the disease. For instance, a disease may be characterized with cold weather. In such a situation, not all communities live in places of cold weather. This can be caused either by the geographical location of the community or the living standards of the community. As a result, the communities have adopted strategies in which they can prevent the disease. A good example of a disease is tuberculosis. Tuberculosis mainly affects the Hispanic community. Therefore, in this paper, a description of tuberculosis, an explanation of why it affects the Hispanic community and the measures taken to prevent the disease by the Hispanic community are discussed.

Discussion

Tuberculosis is a common disease caused by strains of mycobacterium. It is highly infectious, airborne, and it affects the lungs. Patients who are infected with the disease start exhibiting a chronic cough with blood sputum, fever, weight loss and night sweats. There are also chest pains followed by a prolonged cough. Tuberculosis also affects other parts of the body, but the most common infections are the lungs (Centers for Disease Control and Prevention, 2010). When affecting other parts of the body it can cause meningitis and fatigue.

There are certain factors that have made the Hispanic community susceptible to tuberculosis. One of the factors is poverty. The Hispanic communities are believed to be the poorest communities. For this reason, they are finding it extremely difficult to rent a house and impossible to buy one (Chavez, 2011). These results in them in staying in small, crowded apartments located in health risk areas prone to other disease. In this situation, it is easy for tuberculosis to spread from one person to another.

Secondly, they are finding it had to acquire health care facilities that will prevent them from the infections. This is because most of them work in low paying jobs that do not offer health care facilities. As a result, they do not have a defense mechanism for the disease. In the end, they become vulnerable to getting infections from tuberculosis (Chavez, 2011). If they were rich, they would easily acquire health insurance and other facilities making it easier for them to prevent tuberculosis.

Lastly, the Hispanic communities are known to engage themselves in risky behaviors. They engage themselves in alcoholism and drug abuse due to the economic hardships that they experience. As it is commonly known, drug abuse and alcoholism are the number one causes of unprotected sex. Unprotected sex results in HIV/AIDS infection. This affects the immune system that combats diseases. The Hispanic communities end up contracting tuberculosis. It should be noted that this is an environmental factor because they live in an environment where they are infected with HIV/Aids resulting to tuberculosis (Chavez, 2011).

The main mode of transmission for tuberculosis is air, that is, it is an air borne disease. This means that tuberculosis moves from one infected person to another through air. In this case, when a person infected with tuberculosis coughs near a person who is not infected, the saliva will expose the mycobacterium to the air. When the uninfected person breathes the air, he or she is likely to get an infection of tuberculosis. However, there is another mode of transmission, which is indirect. In this case, vectors like mosquitoes help in transmitting the disease. It is not common as compared to air as a form of transmitting tuberculosis.

There are prevention or control measures for tuberculosis. The first control measure is isolation. After the patient is confirmed of contracting tuberculosis, he or she is isolated from the rest of the population for a period of not more than two weeks (Centers for Disease Control and Prevention, 2010). However, this can be more or less, depending on whether the patient is responding to treatment. Additionally, it is essential to check that the patient is not coughing so that they cannot affect the other people who are not infected.

Respiratory protection is another measure of controlling tuberculosis. This is where the person who is treating the infected person wears protective clothing. This clothing should only be worn by the health care workers. It should be free from any other form of penetration, and it should be approved by the relevant health authorities (Centers for Disease Control and Prevention, 2010). This way it will reduce the chances of people who are taking care of the patient from becoming infected. Additionally, it will reduce the fake protective clothing if a relevant authority checked them.

The other measure is the dilution of the environment. In this case, the room or the area in which an infected person is staying should be diluted. This is where contaminants are removed from the air before infect another person who is not infected. In the process, the tuberculosis mycobacterium is removed thus reducing the chances of people getting infections of tuberculosis (Centers for Disease Control and Prevention, 2010).

One of the ways the Hispanic communities are using to protect themselves from tuberculosis is training. Most of the Hispanic leaders are taking the initiative of providing proper training to the Hispanic community about tuberculosis. This initiative is helping them to learn on ways in which they can prevent themselves from contracting the disease. On the other hand, they are gaining proper knowledge of how they can take care of somebody who has contracted the disease (Centers for Disease Control and Prevention, 2010). Finally, they leaders are trying to ensure that the Hispanic communities are getting the best health care.

The Hispanic communities are extremely religious. In their culture, they believe that it is the wrath of God is working on them because they have angered Him. For this reason, they tend to pray so that they can ask for their forgiveness. Despite the fact that the world is changing globally, the Hispanic communities are still attached to their old cultural beliefs. Additionally, the Hispanic culture is associated with drugs and immorality. This results them becoming HIV/Aids thus making them vulnerable to tuberculosis (Centers for Disease Control and Prevention, 2010). For this fact, it has led them to be susceptible to tuberculosis and other diseases.

One of strategies to stop tuberculosis from spreading is training the people how to prevent themselves against tuberculosis. This is because prevention is better than cure. Henceforth, people should learn the modes of transmitting tuberculosis. In this case, they should be trained how to stop the air borne transmission. For instance, they should be taught methods such isolation where there is a health care provider available. Secondly, AIDS is another factor that helps in transmitting the disease. In this case, people should be taught ways in which they can protect themselves from contracting HIV/AIDS disease. For instance, they should be told to have protected sex are other ways that are used for protecting against HIV/AIDS.

Conclusion

Tuberculosis is a common disease that affects the lungs. It is transmitted by air, but there are other ways of transmitting tuberculosis. However, it has been noted that, in America, the Hispanic community is vulnerable to contracting the disease as compared to the other communities. This is because the Hispanic communities are exceedingly poor and the environment that they live in is a health hazard. They are prone to other diseases like HIV/AIDS facilitating the spread of the disease. However, there are ways to prevent the disease from spreading like training, respiratory protection and air ventilation. Therefore, the best strategy of prevention is training to help reduce the disease from spreading.

            Work place discrimination is a contentious issue at the work place. People are discriminated because of factors such as ethnicity, gender or religion among others. One of the reasons why people discriminate against others is the feeling of superiority complex. Some people believe that belonging to one group, such as being white or male, is better or more superior than belonging to other groups, such as being female or African American. Crisis, such as acts of terror associated with a particular group, can also contribute to discrimination. For instance, the events that happened after the terrorist attacks in September 2001 changed many people’s view concerning Islam and Muslims in general. Many Muslims were discriminated against after the attacks (Kaifi et al., 2009). Some of the discriminatory practices include low pay and poor working conditions. In some cases, the minorities receive a significantly lower pay than the people belonging to the majority do yet they have the same qualifications and they have the same level of experience (DelCampo et al., 2011).

The government has enacted laws to ensure that people manage diversity at the work place. Despite the severe penalties enacted for disregarding or breaking the law, some people continue to discriminate those who are different from them. They are largely influenced by misinformation concerning a particular group and their stereotypical opinions. They do not realize that the organization can benefit from diversity. Although the government and management in many organizations have taken an active role in ensuring that everybody is treated fairly in the organization, appreciation of individual differences is often a personal matter. A person’s opinions towards others will affect their opinion and behavior towards them. Some people have high personal values concerning diversity, and strongly oppose discrimination. People will react to diversity based on their idea of justice and their moral values (Triana et al., 2011).

Many organizations are nowadays looking for employees who have different backgrounds. They want people who can understand different languages and religions (Kaifi et al., 2009). They are going to considerable lengths to ensure that their organizations are diverse in every respect. Some organizations hire diversity consultants, offer training programs to their employees to help them understand diversity, and they start diversity initiatives (Stevens et al., 2008). Diversity influences the way people work, especially in groups. Some people suggest that increasing the number of the underrepresented group in a particular work group will lead to a better understanding, and will improve the efficiency of the group (Ely & Thomas, 2001). Diversity should be seen as strength and an opportunity for the organizations, rather than being perceived as a threat. People from different backgrounds will be a positive contribution to a group since they will bring in different ideas, knowledge and perspectives on different issues.  Diversity enhances creativity within the organizations. People come up with ideas that are more creative since they are drawing their ideas from different experiences. They are also more productive, and the quality of their work tends to improve (Stevens et al., 2008).

Despite these benefits, some scholars have noted the fact that diversity tends to increase conflicts at the work place. There is a decrease in social assimilation. People from one particular group will tend to integrate together, leaving the others out. This can be detrimental to the operation of the firm, as people will not be able to cooperate in different activities. People belonging to the minority community can change the way organizations work and how they design their policies. They are more likely to think that they are being corrected because of their physical characteristic. For instance, a woman might tend to think that she has been passed up for promotion because of her gender and this might not necessarily be the case (Stevens et al., 2008).

I have dealt with cases of discrimination at the work place. I saw how discrimination could limit the organization. This happened when I was working at one particular organization where there were very few minorities. I noticed is that the minorities, (in this case women), did not believe that they could accomplish much because that was the attitude in the organization. Many of them were comfortable handling minor roles in the company because that is what they were assigned. Some of the women could have done the job in a better way than the men who were in management positions. I started encouraging women to have faith in themselves. I showed them that they could contribute more to the organization. I then encouraged and compelled the management to have better terms for the women, such as better pay. My strategy worked, and I saw some of the women take leadership positions especially in the human resource department. Since then, the organization has adopted a different approach of management. They have learnt to appreciate diversity, and they recognize that it is more beneficial for them to do so.

Executive Summary

The main aim of this report is to highlight the extent of diversity at the work place. The paper highlights why some people do not accept diversity, and why they tend to discriminate against others. The paper notes some of the benefits of having a diverse work place. It highlights why some of the leaders are taking an active role in ensuring that their organizations are diverse. The paper also shows some of the costs or disadvantages that occur due to having people from different backgrounds working together. Finally, I note one of the experiences I had when working with an organization that did not appreciate or acknowledge diversity.

Introduction

The United States is ranked as the as one of the most influential nations on issues that pertain the global culture (Crother, 2010). Amongst all aspects of the American culture, the entertainment (film and music) industry tops the chart. This is because this industry is not only influential in the entertainment arena, but it has also played a major role in the economic, social and religious aspects of the people. The terms associated with the influence of this culture include Westernization and Americanization. In other cases, the term globalization is meant to identify the effect of America on the rest of the world. Although people have different views as to the extent at which the culture has impacted the rest of the world, the developed, and the developing countries are being affected by it. The American culture has impacted the global fraternity both positively and negatively.

Economic Issues

Crother (2010) feels that the economy has been greatly affected by the film industry. Hollywood is not only affecting the entertainment industry in America, but it is also of considerable influence to the rest of the world. The movies made which make a gross return in billions of dollars have a great economic impact in other countries. This through the tax and the money collected from the imports and selling of movies and television programs exported to other countries from Hollywood.

Since the Hollywood movies are the highest bought movies in the world (Crothers, 2010), other countries have taken this advantage and made some policies which attract Hollywood movie makers to invest in their countries. A country such as Germany for example, does not need movies to be shot in German or use local personnel in order to get a tax reduction on the movie being shot. The laws only require of the films’ shooting to be done by a German company whose shares and copyright are in the future profits. Such advantages made the great movie by Lara Croft known as “Tomb Raider” to collect approximately $87 million dollars before the movie was actually produced.

The world yearns for the Hollywood movies (Matusitz & Payano, 2011). This is because this entertainment industry produces high quality and entertaining films and programs at a very high rate. The tax collected online by the Asian and Europeans countries where movies and programs can be downloaded online is of significant value (Crother, 2010). A country like South Africa charges low taxes on the importation of shooting equipment and the shooting itself as compared to other African countries. Hollywood movie makers prefer going to this country when shooting a movie about Africa. Through this, the country collects more money through the entertainment industries as compared to other African countries.

In many countries, the films that attract large audiences are made in Hollywood. The highly popularized movie named “Avatar” not only attracted a large audience in the cinemas of the United States, but it also attracted a large audience in both the 2D and the 3D versions globally. The films from the United States not only make the cinemas collect millions of dollars annually but they also keep the audiences coming back for more. This is through the film stars, producers and directors that are known in both the United States and the rest of the world.

The film industry in the United States is also very influential in the other film industries in other countries. Matusitz and Payano (2011) found out Hollywood has had both positive and negative influence on the Bollywood of India. On a positive aspect, both entertainment industries work together at times in order to increase the returns in the movies to be made. This is an advantage to both countries. However, there are negative aspects of it.

The films from Hollywood have been known to pose a significant competition on films from Bollywood or other parts or other entertainment arenas. The high competition deprives these other films from gaining the maximum advantage it was a monopoly. For example, a film from the Nollywood of Nigeria faces a competition from a film from Hollywood thus the industry does not make the maximum anticipated return. In relation to other films in a continent like Africa, the Nollywood films and other films from African entertainment industry have only started gaining the needed popularity in the past decade. This was a serious economic blow to the films made earlier. They also face a major competition from the films Hollywood released almost every day.

Social Issues

The movie starring Tom Cruise entitled “Mission: Impossible- Ghost Protocol” is in most screens during this period. This is an action movie starring a very influential person in the entertainment industry. Such stars play a major role in the social conduct of the audience. For example, a movie starring Tom Cruise is likely to entertain more people as compared to a film starring Paul Bettany. This is due to the kind of movies he has made in the past. He is also known to star in films of a diverse genre thus keeping the audience entertained and anticipating.

Tom cruise may be of positive impact to the society, but there are those films brought to the screens that may not influence the audience positively. Taylor (2008) feels that the use and effects of drugs as portrayed in the films brings a mixed reaction to the audience. While drugs are known to be of negative influence as far as people of all ages are concerned, the films portray something different.

Most films portray drugs being mostly used by one type of race, which is mostly the black race (Crothers, 2010). These drugs influence these people to engage in crimes thus the high crime rate among the African American youths. There are films which show the people in the drugs syndicate as people who are wealthy and very influential. This shows the drugs business as a lucrative business that should be encouraged.

On other matters, these films depict fights, killings and weapons as something that is part of life and necessary at times. They fail to bring out the exact impact of crime on the society. For example, some people portray the person who will have killed most as the hero. The two films entitled “Street Kings” portrayed the heroism of the protagonist by showing him as one who killed the culprits when he found them instead of arresting them and subjecting them to the trial they deserved. In the society’s eyes, it is right to make matters of justice into one’s hands. Such themes encourage the level of crime and drug use among the young people who look up to the stars in the movie for inspiration (Taylor, 2008).

There have been numerous discussions that have been held concerning the role of the American entertainment industry in the way the young people dress. Stars in the film industry and especially the female stars, have been known to wear in ways that have evoked a lot of discussions in the media channels. One of the females that stir up such discussions is Pamela Anderson. She is known to wear in ways that may not be of positive influence to the people. Magazines and entertainment channels show female actresses with clothes that reveal their bosoms and their thighs in somewhat indecent ways.

The question of how indecent is indecent may have risen in most cases, but it is quite clear in the countries where the way a woman should wear has been clear for a very long time. In the Arab and the African countries, the females are required to cover as many parts of the body as they can. This mostly includes the thighs and the bosom as it is seen as being decent. However, the films show “sexy” as the woman who wears a dress that is short fitting and showing off her cleavage. Since the films are very influential as far as the young people are concerned, they conclude that wearing the clothes covering all parts of the body is “old school” and wearing the clothes in the film is the “in thing” (Crothers, 2010).

Around a decade ago, the African media were accused of airing a lot of content from the western countries (U.S in this case). This included the music, the television programs and the films (Crothers, 2010). This high percentage of the content from the western countries being aired on the television explained the western influence on the young people. The families in the urban areas for example, preferred using English as compared to using their mother tongue so that they would help their children follow the television programs as well us following the rest of the rapidly developing world.

In matters of the well being of the children, it can be appreciated that children are more courageous when it comes to speaking out their minds and going after what they want, as the films through the media have greatly aided. However, the same films are encouraging the children to do some things that are not common in some cultures such as talking back to their parents. These same children are becoming aware of some issues such as sex, drugs, body development amongst other issues at a very young age. Although this is part of the changing world, the film industry, especially the one in Hollywood, should make a positive impact rather than a negative one.

Most families spend much of their free time watching a television program or watching a movie rather than spending it outdoors. This is one of the main reasons why the entertainment industry plays a major role in the society’s social affairs. If the same messages are seen in the films being aired, then the society takes it to be the truth. If the negative effects of the drugs are not properly portrayed in the Hollywood movies as they should, then the young people globally will continue to venture in the drugs (Taylor, 2008). It is appreciated that the Hollywood films are not the only source of influence, but it is important to appreciate that they play a major influential role in the society.

  Religious Issues

People have various beliefs all over the world although there are some beliefs that are more dominant in some areas than they are in others. The Muslim and the Judaism religions are mostly associated with the Arab countries of the Middle East. Christianity is in America, Europe, Africa and parts of Asia. Buddhism and Hinduism are mostly associated with the Asian continent. Other religions are distributed all over the world. The films from the U.S have had an impact in some religions than they have had in others.

The Muslim religion has been greatly impacted by the entertainment industry. In most movies, they portray the terrorists as being from the Muslim religion. These kinds of the films portray the notion that Muslims are terrorists. They do not need to conclude that, but the audiences make the conclusion (Crothers, 2010). Since most terrorists in these films are from the countries in the Middle East region, it is a double negative effect. The Muslim believers from the Arab countries are terrorists. Such kinds of implications make it hard for the easy co-existence of the Muslim Arab people with other religions and people.

There are many movies that dwell on the cultic activities and magic. Such an influence is not only influential to the young people but to the whole society in general. The epic movies depict the people of the ancient days as having a culture that believed in human sacrifice and other rituals that might be controversial to the young people or people of religions that do not believe in human sacrifice. Every individual has a right to believe in what they want to believe as long as it does not contradict the laws of the land. Unfortunately, the films made in Hollywood do not seem to portray the positive or the negative sides of some cultures that are out rightly wrong.

In the movie, directed by Patrick Lussier and starring Nicholas Cage entitled “Drive Angry” conveyed mixed feelings to the audience. The protagonist of the film, Nicholas cage, had come from Hell in order to prevent a cultic leader who had killed her daughter, from killing his nephew. He killed the cultic leader by using a special gun. By the end of the film, the leader was dead, the protagonist went back to hell, and the child was saved. Such a movies depict that people can get out of hell (an evil place) and do something good (save a life) by committing another evil. In real life, hell is known to be an evil place, and there is no good coming from it. This film seems to contradict that religious believe. The positive aspects about Hollywood films are that they also bring out the good qualities of religion. Most films advocate for forgiveness over revenge or love over hate as the religious teachings guide the people (Crothers).

Conclusion

The films from U.S which are mostly made in Hollywood depict in Hollywood have both positive and negative effects on the global community. However, the negative aspects seem to prevail especially when it comes to social and religious issues. It is significance to note that the United States is viewed as a great country economically. Due to such economic power, people from other countries, especially the developing ones, tend to believe that everything from U.S is both powerful and significant (Crothers, 2010). Many countries look up to what the U.S gives to the world. The nation should therefore give things of positive influence.

Introduction

From a literal standpoint, a critical lens can be considered as the illusions that a person presents to him or herself as being true. Such illusions are normally not true and may go against what is really the case. In The Death of a Salesman, the author utilizes his assertions of the critical lens to project his own themes. I personally agree with the application of this assertion by an author. It enables the reader to identify similarities between two different works. One is able to identify how they relate with each other. There is no meaning in truth if a man only believes what he wants. Critical lens avails itself in many scenes of literature. For an individual to know the truth and appreciate it, he or she has to be willing. If the same person puts his beliefs on something, and it either happens to be false or wrong, it would be very hard for them to appreciate or accept the truth.

People who believe in what they please never care for anything else that matters. Others go to the extent of believing in a material fact because they are afraid of the truth of the matter. The reason might be that the truth poses a threat to their lives or harm them. Arthur Miller’s ‘Death of a Salesman” is a work of literature that supports my understanding on critical lens. Characters depicting this quote are usually not subject to reason and are not open to suggestions. This causes the truth to lack meaning. In Arthur’s Death of a Salesman, there is a character named Willy Loman. Willy plays the role of a loving father with two sons, Happy and Biff; husband to Linda. He is deeply wallowing in the American dream, putting all his beliefs in the dream, thinking that having an adorable status will bring forth great success. Before he was fired, Willy used to work as a traveling salesman. He used to believe that working as a salesperson was his mission and calling in life. In his beliefs, he was never meant undertake any other career.

Nevertheless, Willy never quite excelled in his preferred career as a salesperson. It all seemed that if he engaged in physical work involving his hands, he would be in a better position to succeed. In reality, he would appear much happier and productive when he engaged in physical work. He was very stubborn believing that he would only work well as a salesperson, insisting that he was highly liked by the locals. Willy was not popular or likeable at all. To Willy, this truth possessed no meaning. Under no circumstances would he believe it. If he appreciated this truth and accepted it, then his whole life would have proved to be a waste. This would have meant that he was bringing up his sons with the wrong kind of life mentality.

One literally element visible in Death of a Salesman is reality versus illusion. The element coincides brilliantly with the critical lens quote. Willy is disillusioned by his beliefs not believing what is in front of him. The reality of the situation is the truth and Willy does not want to accept this. He was so engulfed in the illusion thinking that he was leading his sons in the right way. He wanted them to take over the sales business and succeed where he failed, notwithstanding that Biff had other plans of his own.

Death of a Salesman is a brilliant piece of literature art. Arthur Miller’s work in this book helps to depict an interpretation in the quote of critical lens. People believing in something without any regard for a long time, thinking that there is no possibility of their belief being false; usually close out the truth for their own good. Consequently, their actions cause many problems for the people around them as well as themselves. Their beliefs are so strong willed that giving them so much pride, taking lightly every other thing that matters. They do not take into account any advice offered by others or the reality of the matter. For truth to bear any significant meaning, people need to open up to others and seek help regarding the matter. They need to undertake logical thinking and be open-minded to the reality facing them. If this were the case, everybody in general would live happier lives with minimal risks.

Chapter 1: Prehistory and Near Eastern Civilization

There has been rapid global growth and development in the past century. Although it seems as if all this development has taken place in the past century, the current civilization is based on a foundation that is more than five thousand years old. This foundation is frequently revisited when the people want to associate with their heritage. This heritage is made up of both culture and civilization. While culture is frequently passed on from one generation to another and is consistent, civilization is passed on through writing, changing as the changes are made.

Through research and reading through the books of civilization, the Paleolithic period is the earliest civilization period identified with the history of the Homo species. The hominids, the earliest of the homo species, learnt to make tools as well as to use them. They also came up with the rudimentary culture during this period. It is believed that designation of work started taking place in this period. The males hunted for animals and wild fruits while the females, and children did the gathering and the caring for the young.

The Homo sapiens evolved around 200,000 B.C. This species was more developed thus it came up with other tools and skills for survival. This species also developed a religion and other ways of living currently seen. In summary, the Pliocene and the Pleistocene periods were around 1,800,000 years ago. The recent period known as the Holocene period only began around 10,000 years ago. The hominids were around 5,000,000 and 2,000,000years ago. The Homo sapiens evolved in the lower and the middle Paleolithic period. The Holocene period consists of the Mesolithic, Neolithic and the age of metals. This latter period started around 3000 years ago.

As a means of surviving, agriculture was started in Mesopotamia. This word means “land between two rivers” as it is between the rivers Euphrates and Tigris. Settling in this area took place in the year 6000 B.C. the kingdoms of Sumeria, Akkadia and Babylon dwelled and prospered in this area of Mesopotamia for approximately 1500 years. It is significant to understand that these three kingdoms are known as the cradle of civilization. Writing started in Mesopotamia as it was done through inscribing wedge like shapes on clay tablets. The three kingdoms have a difference in religion even though they have the basic of the religions present today. For example, there was the belief in a supernatural force or being.

The Epic of Gilganesh is one of the most famous pieces of literature in the Mesopotamian period. This was a beginning for literature work. The laws were made as way of governing the way people lived. The Mesopotamian laws came before the Hebrew laws. The Sumerian styles served as a foundation for art and architecture. Mesopotamia later connected to Egypt, which is another place is rich in civilization history. From here, civilization has continually spread all over the world changing with place and age.

Chapter 3: Classical Greek Civilization: The Hellenic Age

The Hellenic Age lasted from 479 B.C.E to 323 B.C.E. This period lasted from the time the Greeks defeated the Persians to the Greek’s defeat of the Macedonians. This period of civilization had a few general characters. The main feature was competitiveness and rivalry. This characteristic brought an increase in urban lifestyle. The city started gaining dominance with political, societal and economical issues. The beliefs towards the Olympian deities, who are associated with the Greeks, started changing. People started incorporating the public worship into civic festivities. However, the expansive knowledge of civic rights brought dissatisfaction in the religious aspect of the human life.

Regard for a balanced life is another characteristic of this civilization. It was not about achieving the balanced life, but it was also about how to moderate the means of achieving this balanced life. In other words, the Greeks sort after achieving the two sides of life, which also included the human nature. These two sides of the human nature were symbolized by gods Apollo and Dionysus. The former is the moderation god while the latter is the excess god.

This Hellenic age is also characterized by four phases. They include the Delian League, the wars, the Peloponnesian War and the Macedonian victory, the Spartan and the Theban phases. Through these phases, civilization was in continuum. For example, the emergence of technology came into being through adapting from the people of the past and the present the enlargement of the ships had started taking place by 479 B.C.E. through this technology development and warring period, there was a thirty-year period of peace.

The artistic elements of the Greeks really developed during this age. “Tragedy” in theatre gained a lot of popularity during this period. Tragedy means “goat song” and it was a religious ceremony in prehistory. Different sculptors and other pieces of work were made in order to symbolize different things. For example, black sculptural portraits were made in order to symbolize the black person in Greece. Philosophy, Science and medicine were greatly developed during this age. Socrates, Plato and Aristotle are some of the greatest philosophers of this age. Architecture was developed through the building of sanctuaries while the sculptures and the artwork on the walls were used to the history to other generations.

Chapter 4: Hellenistic Civilization and the Rise of Rome

The Hellenistic age lasted from the year 336 B.C.E and 31 B.C.E. The MacedonKingdom, which is greatly associated with war, is one of the main features of this age. This monarchy had to keep warring in order to prevent the Macedonian Army from turning against them. Under the leadership of King Philip, there was unity as the Macedonian families were brought under control. This is because he had eliminated the rival states. Through his successor, his son Alexander, the empire was able to defeat the Persian Empire. This is something that King Philip had always wanted as a way of revenge. Unfortunately, the kingdom split into more kingdoms through Alexander’s leadership. His generals brought this split as they fought amongst themselves.

The Hellenistic cultures were defined by the Greek-speaking people. Since this was like a continuum of the classical age, a continuity of the art, architecture and learning that had started in the classical age was evident. However, the women were recognized in this age than in the previous age. In literature, the playwrights and poets opted to bring forth deeds that are more thoughtful instead of dwelling on the Kings’ deeds. The philosophers concentrated on the peace of mind while the Scientists dwelt how the natural world had come into being. During this period, these Greek-speaking cities of this age interacted with many people from the west.

Rome came into being during this Hellenistic age. It grew from just being a city-state into being a very big empire. It was not only big but it also became very powerful. Rome became a republic by overthrowing kingship around 500 B.C.E. However, most power was in the hands of the few who were wealthy. It became fight between the patricians (wealthy) and the plebeians (poor) for about 200 years. After some time, the plebeians gained political and legal rights through fights and struggles. Rome slowly grew by defeating such states as Italy, the Carthage and the Celts. Rome did not want to be associated with the Hellenistic world but it later incorporated itself by taking part in the Macedonian Wars. In political and social maters, the wealthy families made up the political arena. There was an obvious difference between the wealthy and the poor and hierarchies constituted the ancient families.

The Roman revolution affected all aspects of Rome. Tiberius and Gracchus, who were brothers, started the attempt to do away with the inequalities present in the roman societies. Expansion of Rome was also part of the revolution. The Romans defeated the Italians in 90 B.C.E. The Triumvirate, which was an alliance between Pompey, a Roman general, Crassus and Caesar, is one of the major achievements of this period. Julius Caesar was also assassinated during this period. The geographical and cultural boundaries of the West were identified during this age.

One of my hobbies is writing. I can write anytime so long as I get a topic to write about. At a young age, I used to draft and write final copies by hand. I used pencils so that I would erase easily in case of errors. I used medium sized letters because I considered them more attractive than small or large letters. I wrote by hand because I did not have a computer. Today, I use a word processor to make drafts and final copies. A word processor is easy and convenient to use. It effectively edits a text by highlighting any errors. For detailed editing, one can use grammar programs to correct mistakes. As I type, I use double spaced format because it looks neater than single-spaced. After I am through with my drafts and final copies, I print them using only one page.

I have great passion in writing and every time I get inspired, I write down my thoughts. I do not like procrastinating because I am always eager to write. If a tutor gives an assignment of an essay, I start immediately. It enables me to have enough time to draft and perfect it. Writing an essay the day before the deadline makes a writer present sub standard work. When I am writing, I think of the ideas that I will discuss. I write them down and then organize them appropriately. The first draft is just an outline of the ideas. The second draft discusses the ideas as they have been organized. If there any changes to be made, I use the second draft. Finally, I write the final draft, ensuring every idea is expressed as expected. If there are any friends around, I usually seek their contribution. I like to specialize on writing about societal issues. It is dynamic, broad and very interesting. When I am not doing school assignment, I do free writing. It helps me to do more practice since I aspire to be a professional writer in the future.

Writing has challenges especially for students. Due to limitation of time, I am not able to do enough research. I do not take enough time to enquire ideas and opinions from other people. This is important because it is a way of improving on how to write. When I do free writing, I just concentrate on one field. I should try and write about other areas. However, I am good at coming up with appealing topics and ideas. I also have a good flow of writing because I usually take enough time to organize my work. My grammar is good because I use the computer to correct and edit my work. My tutors are always pleased with my work. I consider myself a talented writer because when I compare myself with professional writers, I am competitive. One of the areas I will improve is scope of writing. I will explore other areas as well. After completing school, I believe I will be a professional writer.

Trial Process

I. Sequence of Events in a Criminal Case

            The sixth amendment of the US constitution provides offenders and suspects with the right to a speedy and public trial. The prosecutors and the defense usually decide to proceed with a trial when they perceive that they have enough strong arguments to argue their case. The trial is meant to determine the defendant’s guilt or innocence by examining all the evidence and the facts presented to the court. During a trial, the prosecutors usually present their cases before the court. The trial begins with an opening statement. The prosecution begins since it has to prove beyond reasonable doubt that the defendant committed the crime they have been accused of. The defense can choose to give the opening statement after the prosecution although it is not mandatory. The defense attorneys can give their opening statement after the prosecutors have presented their evidence. The prosecution begins presenting its evidence after the opening statement since it bears the burden of persuasion.

The prosecution begins direct examination of the first witness. The defense attorney then cross-examines the same witness. The prosecution then conducts redirect examination of the same witness to clarify any issues that might have arisen during cross-examination. When the prosecutor rests, the defense attorney presents the defendants case to the one trying the case. He presents evidence and witnesses to prove that the defendant is innocent. The defense attorney begins with the direct examination of the witness, and the prosecution follows with the cross-examination. The defense attorney then conducts redirect examination on his client. The procedure is repeated until there are no further witnesses and then the defense rests.

During the trial, both sides may object to the questions being asked due to various reasons such as inadequate knowledge on the part of the witness. The judge can decide to sustain or overrule the objection. After the testimonies, the attorneys on both sides prepare the closing arguments, which are addressed to the one trying the case. The defendant has a right to a jury, although he or she can choose to be tried by a judge. Once all the evidence has been presented, the judge informs the jury about the law it should consider when deciding a verdict. The jury goes to deliberate and then comes with a verdict. The jury then notifies the judge on the verdict and the judge instructs them to read the verdict to the court. The defendant is free to go when he or she is acquitted but sentenced if found guilty of the crime (Ferdico et al., 2008).

II Level of Proof Required in Criminal and Civil Cases

            The level of proof at a criminal trial rests on the government. The defendant in a criminal trial does not have to prove that he is innocent. In a civil trial, the level of proof is usually on the plaintiff. The level of proof at a criminal trial is usually stronger than in a civil trial. The prosecution has to leave no doubt in the jury’s mind that the defendant is guilty of the crime. The jury and the judge presiding over criminal cases must be convinced of the defendants’ guilt, and this is usually harder to do than in civil cases where the plaintiffs have to convince the judge that they have the most convincing arguments. The level of proof in a criminal case must be beyond reasonable doubt. Civil cases require preponderance of evidence or clear and convincing evidence.  Proof beyond reasonable doubt is usually characterized as 95% certainty, while preponderance of evidence is usually characterized as 51% certainty. Clear and convincing evidence in civil cases is characterized as 75% certainty (Whitman, n. d.)

III. Challenges of a Juror during Voir Dire

            The juror faces a challenge for cause and peremptory challenge during Voir Dire. The difference between a challenge for cause and peremptory challenges is that lawyers do not have to give any reason for excusing a juror from a case in a peremptory challenge. A challenge for cause applies when a lawyer perceives that a juror may be biased in a particular case. The lawyer can then excuse the juror for that reason. Jurors are exempted for cause for different reasons. Some of the reasons include eligibility, relationship with any of the parties, mental or physical incapacity, and actual bias among other reasons. Lawyers must give credible reasons why they have exempted jurors if they exercise challenge for cause.

IV. Duties of a Judge in a Criminal Court

            In criminal trials, the judges ensure that the trial is conducted fairly. Judges listen to the evidence presented in the court, and they examine the facts. Judges decide whether to convict or acquit a defendant. When the defendant is convicted, the judges announce the sentence the defendant will receive. Judges are also involved in the selection of the jury, and they direct the jurors concerning their duties in the trial. They advise the jurors concerning the evidence. They tell the jurors which type of evidence is acceptable, and which one they should disregard. They remind and inform the jury concerning the applicable laws in a particular case. The judges also control the direction of the trial, and they ensure that both the prosecutor and the defendants get equal opportunities. When declaring their verdict, the judges highlight their reasons for their decision. The judges also help in maintaining order by settling procedural questions and guiding the conduct in the courtroom (Siegel, 2011).

V. Definition of Reasonable Doubt

            Reasonable doubt is the highest standard of proof, and it is used in criminal trials. It refers to the standard by which prosecutors must convince the judge or the jury that the defendant is guilty of the crime charged. It refers to convincing proof that is based upon reason, which is convincing enough that the jury and the judge can use it to make decisions without hesitating. Whoever is trying the case has to be not only sure but also certain that the defendant is guilty before rendering a sentence.

VI. Role of the Prosecutor and Defense Attorney

a) Role of Prosecutor

The prosecutor represents the state in criminal cases and they bring the cases before the judge. They investigate the case against the defendant, and they use the evidence collected to argue their case before the court. The prosecutors decide which charges they will bring against the offenders. They can change the charge as the evidence directs them to do. They advise the victims and the witnesses concerning the trial proceedings. They review the testimony planned by the witnesses, and they prepare them accordingly. In case they perceive that they do not have a strong case against the defendant, they work with the defense attorneys to arrange a plea bargain (Siegel, 2011).

b) Role of Defense Attorney

The main duty of defense attorneys is to protect their clients and defend them in court. The attorneys present evidence in court to prove that their clients are innocent. They protect their clients during proceedings, and give them legal counsel. They train them on how they should answer specific questions. They protect their clients and the witnesses when the prosecutor seems to be harassing them during cross-examination by asking questions that are out of context. The defense attorney investigates the incident that landed the accused in court so that he can gather evidence. The defense lawyers usually interview all the people deemed relevant to the case such as the police, witnesses and the client. They prepare the case for the trial, and devise the strategies they are going to use. They determine the time that is most appropriate for the appeal, file and argue motions in court (Siegel, 2009).

VII. Questions allowed in Direct and Cross-examination

            The prosecution presents its case in chief by calling and examining lay and expert witnesses and presenting physical evidence in court. The main objective of doing this is to argue a case beyond reasonable doubt. The prosecution presents the evidence in a clearly understood manner. The prosecutors have to be convincing enough and present evidence in a memorable and legally sufficient manner. Leading questions are the norm during cross-examination, but they not allowed during direct examination. They suggest specific answers, giving the defense attorney a chance to present details which may be regarded as evidence, and which the witness will clarify in the end.

VIII. Requirements of a Witness

            A witness is expected to tell the truth in court. Witnesses should not be evasive when giving their testimony. Lying under oath is a criminal offence and the witness can be prosecuted because of this. Witnesses should only give account of what they experienced first hand. They should not base their testimony on hearsay. They should testify what they know, and not speculate. Witnesses testify of what they have heard, seen and experienced. Witnesses should answer the questions addressed to them. They are expected to seek clarification if they did not understand the question clearly. Witnesses should not guess answers, and they should admit to their lack of knowledge if they do not have an answer to a question. Sometimes an expert witness, such as a doctor, is called in to testify in a case. Expert witnesses are professionals with advanced training and knowledge, and who have specialized in a specific area. This type of witness need not be there when the crime was committed in order for them to testify in court. The expert witness interprets the meaning of the facts presented and helps the parties involved to understand the facts. Expert witnesses should use simple language when giving their testimony. Expert witnesses can sometimes overuse of technical language. Witnesses should not discuss their testimonies with other witnesses as this can jeopardize the outcome of the case (Gaines & Miller, 2011).

IX. Order of Closing Argument

            The defense attorneys and the prosecutors make their closing arguments with an aim of convincing the judge or jury. They usually do this after they have presented all their evidence. Closing arguments are important since they convince some of the jurors who might not have made up their mind. The attorneys not only appeal to the judge and the jurors using facts, but they also make strong and emotional appeals. Neither the prosecutors nor the defense attorneys can present new evidence when making their closing arguments.
