Susan is an asset management supervisor at ABC Trucking Company. She has been working at that position for 5 years. She was an asset management accountant for 3 years prior to her promotion to her current supervisor position.
The company owns 500 large and small trucks and 200 smaller vehicles. It also owns several real estate assets such as office buildings, weighing stations, highway rest area gas stations, vehicle repair shops, and truck drivers training facilities.
Susan has an accounting degree and an MBA degree. She is a very capable and efficient employee who received several good performance awards from the company. She is also very popular with all the employees under her.
Recently, Susans immediate boss, the companys Asset Management Director submitted his resignation to take an executive job at another company. He recommended Susan as the best replacement for his position. Susan applied for the managers position as soon as the vacancy was announced.
However, the CEO declined her application stating that she is not qualified for the position. Pending an endorsement and final decision from the companys Board of Directors, the CEO decided to hire a male candidate from outside the company who just graduated with an MBA degree but has no experience at all in asset management.
Susan was disappointed s and dismayed with the CEO decision. She felt discriminated and immediately hired an attorney without waiting for the boards decision, which from her experience has been endorsing the CEOs decisions on everything.
The attorney advised her to challenge the decision as a gross ethical violation based on gender discrimination. The attorney assured Susan that she has a strong anti-discrimination legal basis and that she can win her case in court. However, before proceeding to file the lawsuit in court, she suggested that they should file a complaint with U.S. Equal Employment Opportunity Commission to build a strong case for a lawsuit if she is eventually to go to court.

1. State the facts of this case clearly describing what happened, when, where and by who;
2. Your recommendation on whether US EEOC should take this case and open a file on it;
3. If your recommendation is not to take this case, explain why not. (You have to support your recommendation on basis of anti-discrimination and EEO regulations.
4. Your assessment of what ethical principle or principles are violated; by who and why.
